Section 47.01.390. Alaskan Way viaduct, Seattle Seawall, and state route No. 520 improvements—Requirements—Exceptions.

- (1) Prior to commencing construction on either project, the department of transportation must complete all of the following requirements for both the Alaskan Way viaduct and Seattle Seawall replacement project, and the state route number 520 bridge replacement and HOV project: (a) In accordance with the national environmental policy act, the department must designate the preferred alternative, prepare a substantial project mitigation plan, and complete a comprehensive cost estimate review using the department's cost estimate validation process, for each project; (b) in accordance with all applicable federal highway administration planning and project management requirements, the department must prepare a project finance plan for each project that clearly identifies secured and anticipated fund sources, cash flow timing requirements, and project staging and phasing plans if applicable; and (c) the department must report these results for each project to the joint transportation committee.(2) The requirements of this section shall not apply to (a) utility relocation work, and related activities, on the Alaskan Way viaduct and Seattle Seawall replacement project and (b) off-site pontoon construction supporting the state route number 520 bridge replacement and HOV project.(3) The requirements of subsection (1) of this section shall not apply during the 2007-2009 fiscal biennium.(4) The requirements of subsection (1) of this section shall not apply during the 2009-2011 fiscal biennium.NOTES:Effective date—2009 c 470: See note following RCW 46.68.170.Severability—Effective date—2007 c 518: See notes following RCW 46.68.170.Findings—2006 c 311: See note following RCW 36.120.020.
